Instead of needing parents to be teachers, kids need teachers to get out of the way of their learning. Homeschooling is not about a teacher-student relationship. There are people who are trying to recreate school at home. For the rest of us, though, we an see the school model is broken, and we are not recreating it at home. Homeschooling is a time-honored and widespread practice. It often presents, however, a conflict between the constitutional right of parents to direct the education of their children and the State’s right to impose regulations in the interest of ensuring an educated citizenry. The U.S. Supreme Court has made it clear that any regulation impacting this constitutional right must be “reasonable.” Courts have therefore generally resolved homeschooling cases by examining whether State regulation of homeschooling places an unreasonable burden on the rights of parents. The courts, however, have altogether failed to address another, more fundamental question: whether the State regulation, in fact, advances the State interest. A regulation that fails this criterion cannot be “reasonable.” Using a recent California appellate court case that initially upheld a regulation prohibiting parents from homeschooling their children unless they first obtained a state teaching credential, we show how recent social science research should impact the analysis. Instead of assuming away the issue of whether the regulation advances the State interest, we show that empirical research will allow courts to be able to answer this threshold question.1
Every important movement or trend in this country was followed by an onslaught of legislative actions which resulted in some legal stipulations that controlled the trend. What is really of concern is that this legislative control is not static, but very fluid, subject to change (meaning more restrictions in many cases). These changes occur through either more legislative actions on the part of the government or through interpretation in the judicial system. Currently, the homeschool movement is being closely monitored by various teacher unions, the public and legislative bodies throughout the United States, resulting in more and more laws being passed to control or monitor the movement. If the homeschool movement is to survive in a manner which we feel would be beneficial to us and society as a whole, we have to be more and more diligent in protecting our rights. The only way we can do this is to be more active in the political process. The question now becomes, how do we do this?
